Privacy Policy

At Marmalade Books, we value your privacy and know that your information belongs to you. This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from Marmalade Books or our Shopify site - Marmalade Books Toronto.  Please view the privacy policy for our online store Shopify site if you visit this site as well. 

Because we know that your information is important to you, we always try to keep it at the forefront of our minds in building and improving our site. We try to limit the information we collect to only what we really need and what will be to your benefit. Where possible, we delete this information when we no longer need it.


PERSONAL INFORMATION WE COLLECT
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”
We collect Device Information using the following technologies:

-"Cookies" and “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
- “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

When you subscribe to our newsletter, we collect certain information from you, including your name and email address. Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.”  The purpose of this collection is to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.  The source of this information collection is from you.

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

MINORS
The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.  

HOW DO WE USE YOUR PERSONAL INFORMATION? 

We use the subscription and order Information that we collect to communicate with you and fulfill any orders placed through our Sites (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
• Provide you with regular updates about our ideas and products;
• Communicate with you about your order status;
• Screen our orders for potential risk or fraud.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing campaigns).

SHARING YOUR PERSONAL INFORMATION
We only share your Personal Information with third parties to help us, as described above to fulfill online purchases. If a third party requests your personal information, we will refuse to share it unless you give us permission or we are legally required to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights. When we are legally required to share your personal information, we will tell you in advance, unless we are legally forbidden to do so.

YOUR RIGHTS
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.  Additionally, if you are a European resident, we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

LAWFUL BASIS

Pursuant to the General Data Protection Regulation (GDPR), if you are a resident of the European Economic Area, we process your personal information under the following lawful bases:  your Consent; the performance of the contract between you and the Site; compliance with our legal obligation; to protect your vital interests; to perform a task carried out in the public interest; for our legitimate interests, which do not override your fundamental rights and freedoms. 

YOUR RIGHTS

If you are a resident of the EEA or of California, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased.  If you would like to exercise these rights, please contact us through the contact information below. 

Cookies 

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies through  our Shopify site, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use the website, for instance whether it’s their first time visiting or if they are a frequent visitor.  A list of cookies used to optimize your experience on our Shopify site can be found on that site - marmalade-books-toronto.myshopify.com. 

The length of time that a cookie remains on your computer or mobile device depends on whether it is a “persistent” or “session” cookie. Session cookies last until you stop browsing and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device.

DO NOT TRACK

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.


DATA RETENTION
When you place an order through the Sites, we will maintain your Order Information for our records unless and until you ask us to delete this information.

CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
